These Terms of Service ("Terms") govern your access to and use of the services provided by Holland Digital ("Company," "we," "us," or "our"), including our AI-powered scheduling platform, chatbot tools, and any related websites or applications (collectively, the "Service"). By signing up for or using the Service, you ("Client" or "you") agree to be bound by these Terms. If you do not agree, do not use the Service.
Summary of key points: No refunds. New accounts require a 3-month minimum commitment. Cancel by the 20th of the current month for changes to take effect the following month. We may terminate accounts that abuse our platform, and no refund will be issued in those cases. A free 14-day trial is available — your card will not be charged until the trial ends.
You must be at least 18 years of age and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for business use and is not designed for personal consumer use.
To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@hollanddigital.agency if you suspect unauthorized access to your account.
We reserve the right to refuse registration or cancel an account at our discretion.
We offer a 14-day free trial for new accounts. During the trial period, you will not be charged. To start a trial, a valid payment method (credit or debit card) is required for verification purposes only — this is a standard fraud prevention measure and no charge will be made until the trial ends.
If you cancel before the end of the 14-day trial period, you will not be charged. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged at the rate of your selected plan.
Each person or business entity is entitled to one free trial. We reserve the right to deny trial access to accounts we believe are being created to circumvent this limit.
The Service is offered on a subscription basis. Current pricing is displayed on our Pricing page. We offer the following plan types:
We reserve the right to change pricing at any time. If your rate changes, we will notify you at least 30 days in advance via email. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new price.
All new accounts are subject to a 3-month minimum commitment period beginning on the date of your first paid charge (after the trial, if applicable). During this period, you may not cancel your subscription and will be billed for all three months regardless of usage.
After the 3-month minimum commitment period has been fulfilled, your subscription becomes month-to-month and you may cancel at any time subject to the cancellation terms below.
After fulfilling your minimum commitment period, you may cancel your subscription at any time. Cancellations are subject to the following rules:

The only exception is cases where Holland Digital is unable to provide the Service due to a technical failure on our end, at our sole discretion.
You agree to use the Service only for lawful business purposes and in compliance with all applicable laws and regulations. The following conduct is strictly prohibited:
Holland Digital reserves the right to suspend or permanently terminate your account, with or without notice, if we determine that you have violated these Terms, including the Acceptable Use Policy above. Additional grounds for termination include:
No refund will be issued for accounts terminated due to a Terms violation. If your account is terminated and you believe it was done in error, you may submit a termination appeal (see Section 10).
If your account is terminated and you believe this was a mistake, you have 14 days from the date of termination to submit an appeal. To file an appeal:
We will review all appeals within 5–10 business days and respond via email. Our decision on all appeals is final. Submitting an appeal does not guarantee reinstatement and does not entitle you to a refund.
The Service uses artificial intelligence (including OpenAI's GPT models) to generate chatbot responses, scheduling suggestions, and business content. You acknowledge that:
You retain ownership of all business data and content you upload to the Service ("Your Content"). By using the Service, you grant Holland Digital a limited, non-exclusive license to store, process, and use Your Content solely for the purpose of providing and improving the Service. We do not sell your data. See our Privacy Policy for full details.
Following cancellation or termination of your account, Holland Digital will retain your data (including appointment history, customer records, and business information) for a reasonable period not to exceed 24 months, after which it may be permanently deleted. You may request earlier deletion of your data by contacting support@hollanddigital.agency. Data deletion requests will be fulfilled within 30 days, subject to any legal obligations requiring us to retain certain records.
We strive to maintain reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including third-party service outages). We will make commercially reasonable efforts to minimize downtime and will communicate planned maintenance in advance when possible.
To the fullest extent permitted by law, Holland Digital's total liability to you for any claims arising from your use of the Service shall not exceed the total amount you paid to Holland Digital in the three months immediately preceding the claim. Holland Digital is not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data loss, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Holland Digital and its owners, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any applicable law, or (d) any content you provide through the Service.
All components of the Service — including the platform, website, software, AI systems, branding, and documentation — are the exclusive property of Holland Digital and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written consent.
We reserve the right to update these Terms at any time. When we make material changes, we will notify you via email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms. The most current version will always be available at hollanddigital.agency/terms.
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in DuPage County, Illinois, and you consent to personal jurisdiction in those courts.
